Divorce & Marital Property Division
California is a community property state, meaning that all joint property and debts of a married couple or registered domestic partnership are to be divided equally. Generally, any property or obligations acquired from the date of marriage through the date of separation is considered community property.
This includes any:
- Vehicles
- Bank accounts
- Furniture
- Real estate
- Stocks
- Pension and 401(k) accounts
- Family-owned and operated businesses
- A legal, medical, or dental practice, etc.
Community property also involves your marital debts, such as debts acquired from credit cards, car loans, home loans, or other obligations.
Individual Property
One of the first steps to address when dealing with the division of community property in Los Angeles will be to deal with identifying individual property. Again, the timeline of when you acquired the property will be crucial. Property or debts from before marriage or domestic partnership are generally individual assets and debts. However, while married or domiciled in California, some acquired property could still belong to the individual instead of the couple.
Specifically, separate property owned by a spouse can be classified as follows:
- All property owned by a person before marriage
- All property owned by a person after marriage by gift, inheritance, or devise
- Property that is produced by separate property (examples would be "rents, issues, and profits" of the above)
- Property acquired after the date of separation
